General Terms and Conditions of Sale

ARTICLE 1 - Scope of Application
These General Terms and Conditions of Sale (hereinafter "GTCS") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("The customers" or "The customer"), desiring to acquire the products offered for sale ("The Products") by the Seller on the website bibisphere.fr . The Products offered for sale on the site are as follows:
We offer for sale a range of personalized items and accessories decorated with the exclusive image of our cat.
These products are original and unique creations.
Our catalog includes:
* Clothing: T-shirts, sweaters, and other textiles.
* Other personalized items: Mugs, cushions, Stickers, and various complementary items.
The main characteristics of the Products, and in particular the specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the website bibisphere.fr , which the buyer is required to review before ordering. The choice and purchase of a Product are the sole responsibility of the Customer.
Product offers are valid within the limits of available stocks, as specified when the order is placed.
These GTCS are accessible at any time on the website bibisphere.fr and shall prevail over any other document.
The Customer declares having read these GTCS and accepted them by checking the box provided for this purpose before implementing the online ordering procedure on the site bibisphere.fr
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Products presented on the site bibisphere.fr are offered for sale for the following territories:
-DROM-COM (French Overseas Departments and Regions)
-Member countries of the European Union
-International
(Except:
• Crimea, Luhansk, and Donetsk regions in Ukraine
• Russia
• Belarus
• Ecuador
• Cuba
• Iran
• North Korea
• Syria
• The Gaza Strip region in Palestine).
Deliveries within the European Union (EU):
Products intended for consumers in the European Union are shipped directly by our manufacturing partner. Shipments originate from one of the partner's warehouses located within the EU, specifically in Latvia and Spain. The Consumer is exempt from customs duties and taxes.
This applies except in cases of stock shortages, technical issues, or specific products that are not available in the manufacturer's EU distribution centers.
If an item is shipped from outside the European Union from another distribution center, customs duties, import duties, state taxes, or other local taxes may be eligible.
International Deliveries:
For any order delivered to a country outside the European Union, the Consumer is designated as the official importer of the products in their destination country. Our manufacturing partner has production centers in several countries worldwide. The importer status applies regardless of the initial shipping location.
Customs duties and other taxes (import duties, state taxes, or other local taxes) may be eligible.
Customs duties and other taxes will be borne by and are the sole responsibility of the buyer.
All products shipped within the European Union and Internationally will be subject to a price calculated excluding tax automatically on the invoice.
ARTICLE 2 - Prices
The Products are supplied at the current rates listed on the website bibisphere.fr at the time the order is recorded by the Seller.
Prices are expressed in Euros and exclude tax (VAT not applicable, art. 293 B of the French General Tax Code - CGI).
The rates take into account any discounts that may be granted by the Seller on the website bibisphere.fr
These rates are firm and non-revisable during their validity period, but the Seller reserves the right, outside the validity period, to modify the prices at any time.
The prices do not include processing, shipping, transport, and delivery fees, which are billed in addition, under the conditions indicated on the site and calculated prior to placing the order.
The payment requested from the buyer corresponds to the total amount of the purchase, including these fees.
An invoice is established by the Seller and given to the Customer upon delivery of the ordered Products.
ARTICLE 3 – Orders
It is the buyer's responsibility to select the Products they wish to order on the bibisphere.fr website, according to the following terms:
The Customer builds their cart by adding the products of their choice. They may modify the content of their cart (items, quantities) at any time until the validation of their order.
The payment process takes place in several steps:
1 Information: The buyer enters their contact and delivery details, without the obligation to create an account.
2 Delivery: They select one of the proposed shipping options.
3 Payment: After choosing their payment method, they make the payment. The debit is immediate.
The order is confirmed and becomes final upon validation of the payment. A summary email is automatically sent to the customer, and the order enters the production and then shipping phase.
Product offers are valid as long as they are visible on the site, within the limits of available stocks.
The sale will be considered valid only after full payment of the price. It is the consumer's responsibility to verify the accuracy of the order and to report any errors immediately.
Any order placed on the website bibisphere.fr constitutes the formation of a distance contract concluded between the Customer and the Seller.
The Seller reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order.
The Customer will be able to follow the progress of their order on the site.
The customer has the possibility to cancel their order at any time. If the cancellation occurs before the manufacturing partner has started the execution of the order, the refund will be full. However, if it takes place during the execution of the order or delivery, return fees may apply: a partial refund will be made, minus redirection/return shipping fees. The package must be refused upon delivery; otherwise, the customer will have to send it back to one of our logistics partners (independently of the provisions relating to the application or not of the legal right of withdrawal).
ARTICLE 4 - Payment Conditions
The price is paid via secure payment, according to the following modalities:

The price is payable in full by the Customer on the day the order is placed.
Payment data is exchanged in encrypted mode using the protocol defined by the approved payment provider involved in banking transactions carried out on the website bibisphere.fr
Payments made by the customer will only be considered final after effective receipt of the sums due by the Seller.
The Seller shall not be required to proceed with the delivery of the Products ordered by the customer if the latter does not pay the price in full under the conditions indicated above.
ARTICLE 5 - Deliveries
The Products ordered by the buyer will be delivered to metropolitan France or to the following zone(s):
DROM-COM, member countries of the European Union, and International (except: certain excluded countries).
Delivery Times:
All our products are made by printing or manufacturing on demand.
The process unfolds as follows:
Order Preparation (Manufacturing): The standard time for order preparation by our production partner is 2 to 5 working days. For some products or during holidays (Christmas, New Year's Day, etc...), the production time can be up to 9 working days.
Shipping and Delivery: The package is then shipped to the Buyer's address.
The Seller does not apply a single general deadline. The contractual delivery time is that which is calculated automatically and specifically indicated by the online platform (e-commerce) concerning the product or products ordered by the customer.
• Our production partner has production centers in several countries around the world. Which facilitates and optimizes delivery. Depending on the Buyer's address, the package is shipped from the nearest center.
• The delivery time is calculated precisely and definitively as soon as a tracking number is automatically generated by our production partner when the package is shipped. The Buyer will automatically receive the tracking number of their order by email. He can use it to follow the delivery of his package on the bibisphere.fr website in the "Track my Order" section.
• The contractual delivery deadline is always the latest date (the maximum deadline) displayed by the platform.
Delivery is constituted by the transfer to the customer of physical possession or control of the Product. Except in special cases or unavailability of one or more Products, the ordered Products will be delivered in a single shipment.
The Seller undertakes to make its best efforts to deliver the products ordered by the customer within the deadlines specified above.
If the ordered Products have not been delivered within the indicated time, the customer may set a reasonable additional deadline by sending a formal notice. If delivery has not occurred after the indicative delivery date, for any cause other than force majeure or the customer's fact, the sale may be terminated at the written request of the customer under the conditions provided for in articles L 216-2, L 216-3, and L241-4 of the French Consumer Code. The sums paid by the buyer will then be returned to them no later than fourteen days following the date of termination of the contract, excluding any compensation or deduction.
Deliveries are made by an independent carrier, to the address mentioned by the buyer during the order and to which the carrier can easily access.
When the buyer has taken it upon themselves to use a carrier of their own choice, delivery is deemed to have been effected upon the handover of the Products ordered by the Seller to the carrier who accepted them without reservations. The buyer therefore acknowledges that it is the carrier's responsibility to effect delivery and has no recourse against the Seller in the event of failure to deliver the transported goods.
In the event of a specific request from the customer regarding the packaging or transport conditions of the ordered products, duly accepted in writing by the Seller, the related costs will be the subject of specific additional billing, based on a quote previously accepted in writing by the customer.
The customer is required to check the condition of the delivered products. They have a period of 3 calendar days from delivery to formulate claims. Any claim must be addressed by email to bibisphere@hotmail.com or by mail to the following address:

Requests must be accompanied by photographic evidence (package and product), accompanied by all relevant supporting documents (photos in particular). After this period and failing to comply with these formalities, the Products will be deemed compliant and free from any apparent defect and no claim can be validly accepted by the Seller.
The Seller will refund or replace as soon as possible and at its own expense, the delivered Products whose lack of conformity or apparent or hidden defects have been duly proven by the customer, under the conditions provided for in articles L 217-4 et seq. of the French Consumer Code and those provided for in these GTCS.
The transfer of risks of loss and deterioration relating thereto will only be realized at the moment when the customer physically takes possession of the Products. The Products therefore travel at the Seller's risk and peril except when the customer has chosen the carrier themselves. In this respect, the risks are transferred at the moment of handing over the good to the carrier.
ARTICLE 6 - Transfer of Ownership
The transfer of ownership of the Products from the Seller to the customer will only be realized after full payment of the price by the latter, regardless of the delivery date of said Products.
ARTICLE 7 - Right of Withdrawal
According to the terms of Article L221-18 of the French Consumer Code: "For contracts providing for the regular delivery of goods during a defined period, the period runs from the receipt of the first good."
The right of withdrawal can be exercised online, using the attached withdrawal form also available on the site or any other unambiguous statement expressing the will to withdraw, and notably by postal mail addressed to the Seller at the postal or email coordinates indicated in ARTICLE 1 of the GTCS.
Returns must be made in their original and complete condition (packaging, accessories, instructions...) allowing their remarketing in new condition, accompanied by the purchase invoice.
1. European Union (Returns and Non-Conformity) Any buyer residing within the European Union must return the item within the legal time frame, whether it is:
• Exercising the right of withdrawal.
• Discovering a manufacturing defect or non-conformity of the delivered item.
2. Rest of the World (Outside the European Union) Any buyer outside the European Union:
The obligation to return the item only applies when exercising the right of withdrawal. The customer is not required to return the item in case of a problem or non-conformity (Refund terms will then be applied according to our internal procedures, without any requirement to return the item).
Return shipping costs are the responsibility of the customer.
Damaged, soiled, or incomplete Products are not taken back.
The refund will be made within 14 days of the Seller's receipt of the Products returned by the customer under the conditions set out in this article.
ARTICLE 8 - Seller's Liability - Warranties
The Products supplied by the Seller benefit from:
• the legal guarantee of conformity, for defective, damaged, or broken Products or those not corresponding to the order,
• the legal guarantee against hidden defects resulting from a defect in material, design, or manufacturing affecting the delivered products and rendering them unfit for use,
Provisions relating to legal warranties (French Consumer Code & Civil Code)
Article L217-4 of the Consumer Code
"The seller is required to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was made his responsibility by the contract or was carried out under his responsibility."
Article L217-5 of the Consumer Code
"The good is in conformity with the contract:
1° If it is fit for the use usually expected of a similar good and, where applicable:
* if it corresponds to the description given by the seller and possesses the qualities that the seller has presented to the buyer in the form of a sample or model;
* if it presents the qualities that a buyer can legitimately expect regarding public statements made by the seller, by the producer, or by his representative, particularly in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is fit for any special use sought by the buyer, brought to the seller's knowledge and which the latter has accepted."
Article L217-12 of the Consumer Code
"The action resulting from the lack of conformity is prescribed by two years from the delivery of the good."
Article 1641 of the Civil Code.
"The seller is bound by the guarantee on account of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price for it, if he had known of them."
Article 1648 paragraph 1 of the Civil Code
"The action resulting from redhibitory defects must be brought by the purchaser within a period of two years from the discovery of the vice."
Article L217-16 of the Consumer Code.
"When the buyer asks the seller, during the course of the commercial guarantee which was granted to him at the time of the acquisition or repair of a movable good, for a restoration covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run. This period runs from the buyer's request for intervention or the provision for repair of the good in question, if this provision is subsequent to the request for intervention."
In order to assert their rights, the customer must inform the Seller, in writing (email or mail), of the non-conformity of the Products or the existence of hidden defects from their discovery.
The Seller will refund, replace, or have repaired the Products or parts under warranty deemed non-compliant or defective.
Shipping costs will be refunded on the basis of the invoiced rate and return costs will be refunded upon presentation of supporting documents.
Refunds, replacements, or repairs of Products deemed non-compliant or defective will be made as soon as possible and no later than 30 days following the Seller's finding of the lack of conformity or hidden defect. This refund may be made by bank transfer or bank check.
The Seller's liability cannot be engaged in the following cases:
• non-compliance with the legislation of the country in which the products are delivered, which it is up to the customer to verify,
• in case of misuse, use for professional purposes, negligence, or lack of maintenance on the part of the customer, as well as in case of normal wear and tear of the Product, accident, or force majeure.
• The photographs and graphics presented on the site are not contractual and cannot engage the liability of the Seller.
The Seller's guarantee is, in any event, limited to the replacement or refund of Products that are non-compliant or affected by a defect.
ARTICLE 9 - Personal Data
The customer is informed that the collection of their personal data is necessary for the sale of the Products by the Seller as well as for their transmission to third parties for the purpose of delivering the Products. This personal data is collected solely for the execution of the sales contract.
The customer is also informed that the collection of their personal data is also necessary regarding the following purposes:
In addition to the processing necessary for the execution of the sales contract (taking orders, payment, and delivery of personalized products), your personal data is processed for the following purposes, justified by the legal bases below:
Compliance with Legal and Fiscal Obligations:
Purpose: Retention of transaction data (invoices, receipts) for a legal duration of 10 years in order to meet French accounting and fiscal obligations.
Legal Basis: This processing is justified by the fact that it is necessary for compliance with a legal obligation to which we are subject.
Management of After-Sales Service (SAV) and Warranties:
Purpose: Data processing is necessary to manage returns, refunds, disputes, and the application of legal warranties (notably the guarantee of conformity).
Legal Basis: This processing is justified by the necessity for the performance of a contract (post-contractual warranty obligations).
Sending the Newsletter (Marketing Communications):
Purpose: The email address is collected via the subscription form on the store for sending commercial communications, offers, and promotions.
Legal Basis: This processing is based on the express and prior consent of the user, which can be withdrawn at any time.

Unless the customer expresses their express agreement, their personal data is not used for advertising or marketing purposes.
9.5 Data Retention Period
The Seller will keep the data thus collected for a period of 5 years, covering the statute of limitations period for applicable contractual civil liability.
9.6 Security and Confidentiality
The Seller implements organizational, technical, software, and physical measures regarding digital security to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment and the Seller cannot guarantee the security of the transmission or storage of information on the Internet.
9.7 Implementation of Customer and User Rights
In application of the regulations applicable to personal data, customer and users of the website bibisphere.fr have the following rights:

We undertake to process any request within a maximum period of 1 month.
Legal Exception:
In accordance with the law, data necessary for compliance with our accounting and fiscal obligations (notably invoices) are kept for a period of 10 years and cannot be erased before the expiration of this period.
• They can delete their account by writing to the email address indicated in article 9.3 "Data Controller".
• They can exercise their right of access to know the personal data concerning them by writing to the address indicated in article 9.3 "Data Controller".
• If the personal data held by the Seller is inaccurate, they can request the updating of the information by writing to the address indicated in article 9.3 "Data Controller".

The data controller must provide a response within a maximum period of one month.
In case of refusal to grant the customer's request, the refusal must be justified.
The customer is informed that in case of refusal, they can lodge a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS - FRANCE) or refer the matter to a judicial authority.
The customer may be invited to check a box by which they agree to receive informative and advertising emails from the Seller. They will always have the possibility to withdraw their agreement at any time by contacting the Seller (contact details above) or by following the unsubscribe link.
ARTICLE 10 - Intellectual Property
The content of the website bibisphere.fr is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.
ARTICLE 11 - Applicable Law - Language
These GTCS and the operations resulting from them are governed by and subject to French law.
These GTCS are drafted in the French language. In the event that they are translated into one or more foreign langu
ages, only the French text shall prevail in the event of a dispute.
ARTICLE 12 - Disputes
AMICABLE SETTLEMENT OF DISPUTES - CONSUMER MEDIATION
In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the French Consumer Code regarding the amicable settlement of disputes:
When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within a period of two months, they may submit their complaint free of charge to the consumer mediator. All disputes to which the purchase and sale operations concluded in application of these GTCS gave rise and which have not been the subject of an amicable settlement between the seller or by mediation, will be submitted to the competent courts under common law conditions.
